Entre 1848 y 1874, fueron importados cerca de cien mil chinos al Perú para que trabajaran en las islas guaneras, en los ferrocarriles, pero fundamentalmente en las plantaciones de algodón y azúcar de los valles de la Costa. A los emigrantes se les decía que el Perú era el País de las colinas de Oro (ya que estaba situado en la misma costa que California), donde podrían lograr la felicidad y la riqueza; sin embargo, al llegar aquí se encontraban con un país de colinas de arena donde sólo les esperaba la miseria y la crueldad; aún cuando esta inmigración se produjo sobre la base de contratos de trabajo con un plazo establecido y a pesar de que la esclavitud había sido abolida legalmente al comienzo del período mencionado. Este libro pretende revelar esa parte poco conocida de nuestra historia, con la ayuda de las fuentes jurídicas; y, además, repensar el papel social del Derecho a la luz ele esta perturbadora experiencia. La Parte Primera narra la vida de los coolies chinos en el Perú durante el S. XIX, utilizando la forma de "novela documentada": el protagonista es imaginario; sin embargo todo lo que le sucede -o lo que ve o lo que oye- ha sucedido a alguien y se encuentra minuciosamente acreditado en las notas de pie de página. La Parte Segunda es un estudio de Historia Social del Derecho: quiere conocer y comprender las causas, circunstancias y otros aspectos de la inmigración china desde la perspectiva del Derecho. Apartándose de los principios liberales de la independencia, en el Perú republicano se mantuvo el régimen de trabajo cautivo, lo cual, aunado a los bajos salarios, ahuyentó a los trabajadores oriundos del país de la agricultura costeña. Durante la era del guano, los terratenientes buscaron solucionar la escasez de mano de obra recurriendo a la inmigración extranjera. Esa fue la razón para dictar la Ley del 17 de noviembre de 1849, bajo su normativa ingresaron trabajadores asiáticos y europeos a un Perú poco permeable y receptivo a lo foráneo. El ánimo estigmatizador de los opositores a la migración china en el XIX etiquetó a la ley de inmigración como «ley chinera» y como exclusiva para la migración china. Esta última calificación ha impedido entender la razón de fondo de la referida política migratoria y la persistencia de las formas del trabajo cautivo en el Perú, que fueron impuestas al desprevenido trabajador extranjero. La región Piura, en el norte peruano, es reconocida a nivel cultural y turístico como un espacio destacado por su patrimonio inmaterial, tanto artístico como gastronómico. Este último ha sido puesto en relieve a través de Declaratorias nacionales de patrimonio como aquella concerniente a las Picanterías y chicherías piuranas como espacios culturales (2015). No obstante, la tradición cultural piurana, en todas sus formas, como ha ocurrido en el Perú, se ha enriquecido a través de las aportaciones de diferentes grupos migrantes, como el chino, coexistiendo y creando una cultura culinaria diversa, con prácticas y sabores apropiados y resignificados por la memoria colectiva local. Piura fue un departamento que, en la segunda mitad del siglo XIX, recibió una minoritaria población migrante china, en comparación con regiones como Lambayeque y La Libertad (Gutiérrez y Vargas, 2016, p. 76). Pero, como ocurrió en otros lugares con mayor densidad migrante, las fondas tuvieron aparición temprana y, posteriormente, los chifas. ¿Qué productos ofrecían y cómo esta culinaria fue acogida por la población local? ¿Qué insumos locales habrían aportado en esa fácil incorporación del chifa en las mesas piuranas? Y, ¿qué memorias se asocian a estos espacios gastronómicos? son algunas cuestiones que, desde la investigación documental y testimonial, esbozamos en una primera aproximación a este tema no abordado en la literatura histórica sobre la región Piura.
